1. About these terms
One4Future lets you record videos, voice notes, letters and photos now and have them delivered to the people you choose later: on a date, on a birthday, when people you trust confirm that something has happened, or, with Legacy mode, after you can no longer send them yourself.
One4Future is provided by TheAzWay ("we", "us"). You can contact us at info@theazway.com.
By creating an account you agree to these terms and to our Privacy Policy. Please read them, and especially section 4 and section 5, which explain decisions that are yours and ours.
2. Your account
You must be at least 18 to create an account.
You sign in with a code sent to your email address. Keep access to that email account secure: anyone who controls it can sign in as you. Tell us straight away if you think someone else has access.
Keep your email address and your recipients' and trusted people's details up to date. We deliver to the addresses you give us and cannot correct them for you.
3. Your messages
Your messages stay yours. You give us permission to store them, check them for viruses and malware, and deliver them to the people you choose, only as needed to run One4Future.
You are responsible for what you record and send, and for having the right to share it, including anything showing or about other people.
You are responsible for having a good reason to give us the names, email addresses and birthdays of the people you add, and for telling them where appropriate.
Your messages are encrypted in storage, and our support tools never show your messages, their titles or the names of the people involved. We do not read, review or approve messages before they are delivered.
Once a message is delivered, the recipient can save it and share it. We cannot take it back from them.
Keep your own copy of anything important. One4Future is not a backup or archive service.
4. How delivery works
You decide who receives a capsule and when. We deliver it according to the settings you chose:
On a date or birthday: we deliver on or after the date and time you set, in the recipient's time zone where you gave one.
When something happens: we deliver 24 hours after the number of trusted people you chose confirm that the event has happened. We do not check whether it really has; we rely on them.
Delivery is by email and sign-in. We email the recipient a link; they open the capsule by signing in with that email address. If the address is wrong, no longer used, or the email is filtered as spam, they may not receive or open it.
Before anything is sealed or delivered, each file must pass an automatic virus and malware check. A file that fails is not sealed or delivered.
We aim to deliver at the right time but cannot promise to the minute. Deliveries can be delayed by maintenance, outages or events outside our control.
Until a capsule is delivered you can change it: unseal it, edit it, or revoke it so it is never delivered.
5. Legacy mode
Legacy mode can deliver your messages while you are still alive if you stop responding and your trusted people confirm. Please read this section carefully. You must accept it in the app before you can use Legacy mode.
5.1 What Legacy mode is, and is not
Legacy mode delivers capsules you mark as "legacy" when you have stopped checking in and your trusted people confirm. It is designed for messages to be read after your death or when you can no longer send them yourself.
It is not a will, not a legal document, and not an estate, legal, financial or medical service. It does not transfer money, property or rights, and it does not replace legal advice.
We do not know, and do not check, whether you have died or can no longer respond. We never ask for or verify a death certificate. Delivery depends entirely on the settings you choose, whether you respond to us, and what your trusted people tell us.
5.2 How it works
You choose how often you must check in (for example every 30 days) and how long we remind you before asking anyone else. Opening the app counts as a check-in, as does tapping "I'm here".
If you do not check in, we send you reminders by email.
If you still do not respond, we ask your trusted people. Every trusted person you named must confirm. With a single trusted person, we must also first try to phone you, where phone checks are available.
Once they have all confirmed, we send you a final warning and wait 7 days. If you do nothing in that time, your legacy capsules are delivered.
You can stop this at any time before delivery by checking in. We may also place a hold on a plan if something looks wrong.
5.3 Your responsibilities
Choose trusted people carefully. Pick people who will only confirm when they genuinely know you have died or can no longer respond, and tell them what you expect. Two trusted people are safer than one.
Respond to reminders. Keep your email address current, and check in if you will be away, in hospital or without internet for longer than your settings allow. If you do not respond, your capsules can be delivered while you are alive.
Choose settings that fit your life. Longer check-in and reminder periods make an unwanted delivery less likely.
Think about what you send. Anything delivered can be saved and shared by the recipient and cannot be taken back.
5.4 What we are and are not responsible for
We are responsible for running Legacy mode as described in these terms: sending reminders, asking your trusted people, sending the final warning, and not delivering before those steps are complete.
Because you choose the settings and the trusted people, and delivery depends on you not responding and on their confirmations, we are not responsible for a delivery that happens because those steps were completed as described, including if you were alive, if a trusted person was wrong or dishonest, or if you did not see our messages. See also section 10, which explains what we cannot exclude.
We are not responsible for the consequences of what your messages say, or for any legal effect people give them.
6. If someone trusts you
If someone names you as a trusted person, you do not need an account until you are asked to act. By confirming or declining you agree that:
you will only confirm an event, or confirm for Legacy mode, when you honestly believe it has happened (for Legacy mode: that the person has died or can no longer respond);
you are responsible for your confirmation, and for keeping access to your email account secure;
you will not see the messages; you only see the person's name and, for events, what the event is.
We may suspend anyone we believe is misusing a trusted role.
7. If a message is sent to you
You open a capsule by signing in with the email address it was sent to. The first account that opens a capsule, or that answers a trusted-person request, keeps it: another account cannot open it later, even with the same email address. You may save, share and reply to what you receive. If you do not want to receive capsules, contact us.
8. What you must not do
Send anything illegal, threatening, harassing, hateful, sexually explicit involving anyone under 18, or intended to harm or deceive the recipient.
Upload viruses or malware, or try to get around our security, limits or checks.
Use One4Future to send spam or messages to people who have not been given a reason to expect them.
Pretend to be someone else, or name people as recipients or trusted people to trick them.
We may suspend or close accounts that break these rules, and may report illegal content to the authorities.
9. The service
One4Future is currently free. If we introduce charges, we will tell you in advance and you will only pay for what you choose to buy.
We keep improving One4Future and may change features. If a change significantly affects capsules you have already sealed, we will tell you.
Capsules can be set years ahead, but we cannot promise that One4Future will exist for ever. If we decide to close it, we will give you at least 90 days' notice by email and the chance to download your messages.
10. Our responsibility to you
Nothing in these terms limits or excludes our liability for death or personal injury caused by our negligence, for fraud, or for anything else that cannot be limited or excluded by law. Nothing here affects your statutory rights as a consumer.
We are responsible for loss you suffer that is a foreseeable result of us breaking these terms or failing to use reasonable care and skill. We are not responsible for loss that is not foreseeable, for business losses, or for loss caused by events outside our reasonable control.
We are not responsible for deliveries made, or not made, because of the settings, email addresses and trusted people you chose, or because recipients' email providers filtered or blocked our emails.
Where the law allows, our total liability to you is limited to the greater of the amount you paid us in the 12 months before the claim, or £100.
11. Ending your account
You can delete your account at any time in the app (Me, then Delete my account). You choose whether capsules still waiting are deleted or still delivered.
You can download a copy of your data at any time (Me, then Export my data).
We may suspend or close your account if you seriously or repeatedly break these terms, or if we are required to by law. Where we can, we will tell you first.
12. General
We may update these terms. If a change matters to you, we will tell you before it takes effect; for Legacy mode you will be asked to accept the new version before you can change your plan.
These terms are governed by the law of England and Wales. You can bring proceedings in the courts of England and Wales, or, if you live in Scotland or Northern Ireland, in your local courts.
If any part of these terms cannot be enforced, the rest still applies.
